Custodex is a digital wellbeing and independent living platform that provides automated check-ins, emergency alerts, and emergency planning tools. The Service is designed to enhance personal safety but is not a substitute for professional emergency services (911 or local emergency numbers).
Custodex is not an emergency service and should not be used as a replacement for 911 or your local emergency services.
In case of immediate danger or emergency, always contact your local emergency services (911 in the US) first. Custodex is designed as a supplementary safety tool to alert your personal emergency contacts, not to replace professional emergency response services.
As a user of Custodex, you agree to:
You maintain full control over your privacy settings. You may disable location sharing, update emergency contacts, or close your account at any time via the Settings page.
While we strive to provide reliable service, we cannot guarantee:
We may temporarily suspend or restrict access to the Service for maintenance, updates, or security purposes.
To the maximum extent permitted by law, Custodex and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from: (a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers; (c) any interruption or cessation of transmission to or from the Service; (d) any bugs, viruses, or the like that may be transmitted to or through our Service; (e) any errors or omissions in any content; or (f) any loss or damage of any kind incurred as a result of your use of any content posted or shared through the Service.
You may terminate your account at any time through the Settings page. We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or illegal activities.
Custodex is free to download. Some features require a paid subscription (Personal or Family plans). Personal and Family plans include a 7-day free trial, no credit card required to begin. By subscribing, you agree to pay all applicable fees. Subscriptions automatically renew unless cancelled before the renewal date. Refunds are provided according to our refund policy.
All content, features, and functionality of the Service are owned by Custodex and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our explicit permission.
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Custodex operates, without regard to its conflict of law provisions.
